Abstract

This paper tries to explain the basic and principles of alternative legal maxim in Islamic law formulation which is initiated by Jaringan Islam Liberal (JIL), and see their criticism to old legal maxim of Ushul Fikih already considered established. To unravel this problem, the author conducted a literary study to examine a writing of a JIL activist, Moqsith Ghazali, entitled “Merancang (Kaidah) Ushul Fikih Alternatif”. The study concludes that the JIL legal maxim of Usul Fikih alternative have a purpose to release legal experts (mujtahid) from dependence on text, change old habits from the literal to the substantial, from textual to contextual. While the basis for the alternative rules formulation are maṣlaḥaḥ and maqāṣid al-Sharī’ah which are contained in eight fundamental principles they believe. The eighth principles are: justice (al-‘Adālah), maslahah (al-Maṣlaḥah), equality (al-Musāwah), power of wisdom (al-Ḥikmah), love (al-Raḥmah), pluralism (al-Ta’addudiyah), human rights (Huqūq al-Insān), and equality of gender (al-Musāwah al-Jinsiyyah).
