Abstract

This paper attempts to discuss two things. First, the history of family law reform in the Muslim world. Second, Qasim Amin thoughtful contributions to the process of family law reform happening in the Muslim world. The process of family law reform in the Muslim world is not born out naturally. The reform was born due to the fact that the conventional family law is not in accordance with the challenges of the times. The fundamental purpose of Islamic family law reform is to raise the status of women. Even so, the contribution of Qasim Amin in the process of family law reform happening in the Muslim world can be traced from his idea of social reform project (al-Is}la>h} al-ijtima>i). For Amin, the process of social reform would only be successful if there is a family law has been updated and brought in line with the demands of the times. The ideas of family law reform, primarily on three crucial themes, marriage, polygamy, and divorce, have been said in Amin’s first work, Tah}ri>r al-mar’ah (1899).
