Abstract

In economic practice and idea of Islam these days nowadays have given spirit to all man of science to peep at or even do study about truth of Islam. Various related/relevant new growths in the field of economics like problem of commerce transaction pattern and including also growth of monetary instrument which discussed in this thesis. All of him is new matters which require studying by more circumstantial. Islamic Finance, including financial system and its instrumentation of Shari'ah is finance based; monetary which logically use principle, procedure, and assumption at the same time application and instrumentation of value of epistemology Islam, namely Al-Qur'an and of As-Sunnah. Process select share matching with Shari'ah represent one of the aspect in system operational of management monetary of Islam. As simplification can be said that by investment equity representing ideal investment form to Moslem unit surplus have to be relied on sharing holder system (loss-sharing and profit) where return by theoretic reflect profitability of its business underlying. Giving of dividend pre-determined fixed in mechanism applying of share of preference become especial central refusing of share of preference in Islam, because categorized to tend to flange at existence of clear lap element and its ban absolute. Even given by reverence is share of preference in the case of division of dividend told to earn legal also return of advantage between partners. And so do in company liquidation case, stockholder of preference can accept all value assess from the top of their shares exceed ordinary stockholder. In here which need we question do them in fact more is acting as of lender or as job partner. Justice as especial base of Shari'ah in reaching bliss of life in eternity and world have not a meaning of same flatten is same feel. Fair isn't brutal. Exploration conception justice and if related to the division of stock dividend of preference will become very discussion of urgent as base of activities assessment and transaction critically to available instruments is market. Therefore, solution about justice concept of is division of stock dividend of preference in this Islam perspective represent step early to push development of new theories of Islamic Finance and its application in the form of instrumentation and institutionalization, and also the existence of furthermore research which more comprehensive.
