Abstract
Syari’ah is closely related with tasyri’. Syari’ah deals with divine law while tasyri’ constitutes the stipulation of the law. Knowledge of tasyri’ is knowledge of procedures, principles and purposes of Allah stipulating laws. Syari’ah is law of human conduct, either fundamental or supporting law, originated from al-Qur’an and al-Hadits. Law is defined as "the divine commandments of Allah concerning conducts of mukallaf that could be obligation, preference, as well as prohibition". Fiqh scholars define it as "consequence desired by the divine commandments of Allah for human, such as obliged, illicit, or preferred conducts. Fiqh is knowledge of syara’ laws concerning human conducts derived from elaborated divine theorem. Syari’ah covers broader range than Fiqh because Fiqh is a part of syari’ah. The source of Syari’ah is nash of al-Qur’an and al-Hadits, while the source of Fiqh is the thought of moslem scholars. Syari’ah consists of infinitive (everlasting) substance while that of Fiqh might change and is relatively adjustable. Kata kunci: Syari’ah, Hukum dan Fiqh
