Abstract
In term istimbatul hukmi in fact Ibnu Hazm gave priority Al-Dalil taken from Nash and Ijma’ and he always avoid from qiyas and istihsan because qiyas and istihsan out take out from us truth as nash. Other nise al-dalil taken from nash consistens of 7 kinds, nomely an nash from two prepaces takes from two Nofijah (Conclu sions), appachies fill syaras connecting with special chonecfing, the word that is applonance in nash will have general meaning, unless written in nash is mubah, a Qodhiyah arranged if general mentioned si specifict is also mentioned and the word nash has mentidenmentional meaning. Which al dalil in general term is “istimbatul hal“ al hukum ala jamiihim and aqasslu ma jila.
